How do I modify my terms of use (DPA) to include additional information?

Since Mindmatrix is GDPR and CCPA compliant, the terms of use in the product are required, and visible for every user who logs into the product to accept. This article will give you insight on your options as a client to enhance the existing terms of use page to share information with your users/partners.

These terms of use protect our clients and their partners, by stating clear responsibilities for Controllers vs Processors under EU regulations. By clicking accept, users of Mindmatrix software are agreeing that they understand they have particular responsibilities under these laws, and that Mindmatrix as a processor, is also responsible for providing GDPR compliant options for them to manage the personal data of contacts who may be citizens of the EU.

There are two forms of the agreement in the Mindmatrix product, one for partners, which are partners of your company as a Mindmatrix client, and one for Mindmatrix clients, which are for employees of your company who access Mindmatrix software.

Notes
Since in most cases, it is not possible for Mindmatrix to distinguish between a partner or employee before they login, both terms of use are displayed in the partner portal with a designation of "For Partners" or "For Customers". You can preview the appearance of this, by viewing the terms of use linked on our website.

How can I clear up confusion for users who login when using the platform?


Aside from communications you can send to partners to ensure they are aware of their responsibilities, you can also opt to add an explanatory paragraph ahead of the Mindmatrix terms of use. Some clients choose to use this paragraph to explain their company's relationship to Mindmatrix. Such as:

(COMPANY NAME) is contracting email marketing and sales enablement tools for our partners through Mindmatrix. Mindmatrix a third party provider of the software behind (PARTNER PORTAL NAME) and is responsible for processing data added by users like yourself, who login to the software. The terms of use below describe Mindmatrix's responsibility as a data processor and your responsibilities as a Controller (owner and distributor) of any personal contact data you add to the software. In order to use the email marketing and data storage tools provided by Mindmatrix for (PARTNER PORTAL NAME) you must review and agree to the terms below.

Some clients also decide to add their own terms of use below this paragraph, so that their partners can accept the necessary agreements in one spot before accessing the platform for the first time. We frequently will allow clients to add a title, such as "(COMPANY NAME) TERMS OF USE", and then their own text.


You can find a link to this hosted on the Mindmatrix website. It is also accessible for users once they hit accept, by clicking a link in their user profile.

How can I add to the existing terms of use?


For security we require users to work with Mindmatrix support to ensure that their terms are properly updated. You can email our team at support@mindmatrix.net, and we will request the required information to schedule an update to your partner portal.
